1. Who you're contracting with

These terms govern your purchase and use of services from Foster Physique ("we", "us", "our"). Including 1 on 1 personal training, the 4 month Fitness Program, the Tailored Meal Guide, and bundled offerings. By purchasing, accessing, or using our services you accept these terms. If you don't agree, don't use the services.

2. Eligibility

You must be at least 18 years old (or have parent/guardian consent) and physically able to participate in fitness training. You confirm you've consulted a medical professional if you have any condition that may make exercise unsafe.

3. What we provide

4. Acceptable use

You agree not to: (a) use the services unlawfully or fraudulently; (b) share, resell, or redistribute any digital program, meal guide, or video content; (c) reverse-engineer or scrape our site; (d) infringe anyone's intellectual property; or (e) interfere with the security of our services.

5. Intellectual property

All programs, meal guides, videos, branding, and written content are owned by Foster Physique. You receive a limited, non-exclusive, non-transferable license to use them for your personal training only. You may not redistribute, publish, or commercially use any materials.

6. Payments, billing, and refunds

Payments are processed securely by our payment processor, which handles checkout, billing, tax calculation, and refunds on our behalf.

Our refund window is documented in our Refund Policy.

7. Service level

We make every effort to keep our digital services available, but we don't guarantee uninterrupted or error-free performance. in person session scheduling depends on mutual availability.

8. Health disclaimer

Our coaching and nutrition information is for general fitness purposes only and is not medical, dietetic, or therapeutic advice. Always consult a qualified medical professional before starting any new training or nutrition program. You assume all risk of injury, illness, or other adverse outcomes from participation.

9. Warranties and liability

To the fullest extent permitted by law, we disclaim all implied warranties (merchantability, fitness for a particular purpose, non-infringement). Our aggregate liability for any claim arising out of the services is capped at the fees you paid in the 12 months prior to the claim. We are not liable for any indirect, consequential, special, or incidental damages including loss of profits, data, or goodwill. Nothing in these terms limits liability for fraud, death, or personal injury where the law forbids such limits.

10. Suspension and termination

We may suspend or terminate your access to services for: material breach of these terms, non-payment, security or fraud risk, or repeated violations of our acceptable-use policy. On termination, your license to digital materials ends; refunds (if any) are governed by our Refund Policy.

11. Changes to these terms

We may update these terms from time to time. Material changes will be reflected here with an updated "Last updated" date. Continued use of the services after changes means you accept them.

12. Governing law

These terms are governed by the laws of the State of Florida, USA. Any disputes will be resolved in the state or federal courts located in Hillsborough County, Florida.
