RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT In consideration of being permitted to participate in personal training, strength & conditioning, hypertrophy, and related fitness activities ("Training") provided by Malcolm Foster d/b/a FosterPhysique ("Trainer"), I acknowledge and agree to the following: 1. ASSUMPTION OF RISK. I understand that physical exercise, including but not limited to resistance training, cardiovascular training, plyometric work, and use of free weights, machines, and bodyweight movements, involves inherent risks of injury. Including muscle strains, sprains, fractures, cardiac events, heat illness, and in rare cases, serious injury or death. I voluntarily and knowingly assume all such risks. 2. PHYSICAL CONDITION. I represent that I am in good physical health, have no medical condition that would prevent safe participation, and have consulted a physician if I have any doubt about my ability to train. I will immediately disclose any injuries, medications, pregnancy, or medical conditions to the Trainer. 3. RELEASE AND WAIVER. I hereby release, waive, discharge, and covenant not to sue Malcolm Foster, FosterPhysique, and their respective agents, employees, and assigns from any and all liability, claims, demands, or causes of action arising out of or related to any loss, damage, or injury sustained while participating in Training, whether caused by the negligence of the released parties or otherwise. 4. INDEMNIFICATION. I agree to indemnify and hold harmless the released parties from any loss, liability, damage, or cost they may incur arising out of my participation. 5. MEDIA RELEASE. I grant permission for photos or video taken during sessions to be used for FosterPhysique promotional purposes, unless I notify Trainer in writing otherwise. 6. GOVERNING LAW. This agreement is governed by the laws of the State of Florida and constitutes the entire agreement between the parties. I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, AND SIGN IT FREELY AND VOLUNTARILY.
